Offer Agreement

Limited Liability Partnership “RailDev” (hereinafter – “Provider”) hereby publishes this Offer Agreement, a public offer to individuals and legal entities for the provision of career orientation services via the websites https://profroad.kz and https://app.profroad.kz.

1. General Provisions

1.1. This document constitutes a public offer in accordance with Article 395 of the Civil Code of the Republic of Kazakhstan.
1.2. Acceptance of this Offer occurs when the User registers on the Platform and/or uses any services—such as taking a test.
1.3. Upon acceptance, the Agreement becomes effective between the Provider and the User.
1.4. The services include career‑orientation tests, analytical reports, and advisory content.
1.5. The Provider reserves the unilateral right to amend the Offer, and changes take effect upon publication on the Site.

2. Definitions

Site – https://profroad.kz;
Platform – https://app.profroad.kz;
Services – online testing, analysis, and career‑guidance recommendations;
Tariffs – fees for paid services, displayed on Site/Platform;
User – individual or entity who has accepted the Offer.

3. Subject of the Offer

3.1. The Provider grants the User access to career‑orientation services via the Site and Platform.
3.2. Some services may require payment under the applicable tariff.
3.3. Services are provided remotely; they are advisory and do not constitute medical/legal/therapeutic consultancy.

4. Rights and Obligations of the Parties

User:
4.1. Entitled to receive Services;
4.2. May contact support;
4.3. May demand confidentiality of personal data.

User obligations:
4.4. Provide accurate information during registration;
4.5. Not to use the Site/Platform unlawfully;
4.6. Comply with the Offer terms.

Provider’s rights:
4.7. Modify features, design, or content;
4.8. Temporarily suspend service for maintenance;
4.9. Amend tariffs unilaterally.

Provider’s obligations:
4.10. Ensure service availability (except during technical maintenance);
4.11. Protect personal data in accordance with Kazakhstani law.

5. Personal Data Processing

5.1. By accepting the Offer, the User consents to the processing of their personal data.
5.2. Purpose: providing Services, statistical and marketing analysis.
5.3. Processing is performed in compliance with the laws of the Republic of Kazakhstan.

6. Liability

6.1. Parties are liable under the laws of the Republic of Kazakhstan.
6.2. The Provider is not liable for decisions made by the User on the basis of test results.
6.3. No guarantee of any career or educational outcome is given.
6.4. In case of technical disruptions, the Provider shall take reasonable steps to restore service or compensate.

7. Final Provisions

7.1. The Offer becomes effective upon acceptance and remains in force indefinitely.
7.2. All amendments are effective upon publication on the Site.
7.3. Disputes are to be resolved first by negotiation, then in court at the Provider’s location.
